Welcome to the African Virtual University.
The African Virtual University (referred to as "AVU") provide this web site and services to you under the following terms and conditions of use. PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY. By using this site, you are deemed to have agreed to these terms and conditions of use. AVU reserves the right to modify these terms and conditions at any time. You should check these terms and conditions periodically for changes. By using this site after AVU posts any changes to these terms and conditions, you agree to accept those changes, whether or not you have reviewed them. If at any time you choose not to accept these terms and conditions of use, you should immediately cease using this site.
Scope of Terms and Conditions
These terms and conditions apply to your use of all of the sites and services owned or operated by AVU, including www.avu.org, and any other site that AVU may own or operate in the future (collectively, the "AVU Sites").
Description of Service
AVU provides users with access to a rich collection of resources, including, various communications tools, forums, personalized content and branded programming (including the use of AVU's digital library) through its delivery network ("Service"). Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new AVU services, shall be subject to these Terms and Conditions of Use. You understand and agree that the Service is provided "AS-IS" and that AVU assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store or reproduce any user communications or personalization settings. You are responsible for obtaining access to the Service and that access may involve third party fees (such as Internet service provider or air time charges). You are responsible for those fees including any fees that may be charged by AVU for access to branded content. In addition, you must provide and are responsible for all equipment necessary to access the Service.
Registration
Certain AVU services require the eligible user to open an account. If you are eligible for these services and wish to open an account, you must complete the registration process by providing AVU with current, complete and accurate information as prompted by the applicable registration form. You then will choose a password and an user name. You are entirely responsible for maintaining the confidentiality of your password and account.
In consideration of your use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the applicable registration form (such information being the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or AVU has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, AVU has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).
User Account
You are entirely responsible for any and all activities that occur under your account. You agree to notify AVU immediately of any unauthorized use of your account or any other breach of security. AVU will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by AVU or another party due to you or someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.
Restrictions on Use of Materials
The contents of the AVU Sites are protected by copyright and trademark laws, and are the property of AVU and any and all other owners. Unless AVU give you express written permission, you may access the materials located on the AVU Sites only for your personal use. This means you may download one copy of such materials on a single computer for personal, noncommercial use only, so long as you neither change nor delete any author attribution, trademark, legend or copyright notice. When you download copyrighted material you do not obtain any ownership or other rights in that material.
Except as stated above, without AVU's prior written consent you may not otherwise modify, copy, publish, display, transmit, adapt or in any way exploit the content of the AVU Sites. To seek AVU's permission, please send an e-mail to webmaster@AVU.org . You may also be required to obtain permission from third parties owning or holding an interest in certain content. Even if permission is granted by AVU and by all other entities owning or holding such an interest, you may not change or delete any author attribution, trademark, legend or copyright notice.
You must abide by all additional copyright notices or other restrictions contained in any of the AVU Sites.
Links
AVU is not responsible for the availability of any third party site to which any of the AVU Sites links. AVU does not endorse or take responsibility for the contents, information, advertising, products or other materials made available through any third party site. With respect to any content, goods or services available on any third party site, under no circumstances will AVU be held responsible or liable, directly or indirectly, for any loss or damage that is caused or alleged to have been caused to you in connection with your use of, or reliance on, any such content, information or materials. You should direct any concerns to that third party site's administrator or webmaster.
Other sites may link to AVU Sites only as approved by AVU. Contact AVU at webmaster@AVU.org . AVU reserves the right to rescind any permission and to require termination of any such link to any of the AVU Sites, at AVU's discretion at any time.
Interactive Features
An "interactive feature" means any type of forum, message board, chat room, annotation feature, or similar interactive service appearing on any of the AVU Sites, now or in the future. You must register in accordance with instructions that you will find on the AVU Sites in order to contribute to any interactive feature. No person under age 15 may register with AVU, or contribute to any interactive feature.
You may not contribute to any interactive feature any material that is libelous defamatory, obscene, abusive, invades a person's privacy, violates any intellectual property rights, or that would otherwise violate any law. You may not use any interactive feature in a commercial manner. You may not post material that solicits funds, or that advertises or solicits goods or services. You may not post material known to be false. You may not post or transmit any information, software or other material that contains a virus or other harmful component.
AVU is not responsible for material appearing in any interactive feature on the AVU Sites, except for material signed by an identified representative of AVU. AVU is not responsible for screening material posted by users for libel, obscenity, invasion of privacy, copyright or trademark infringement, accuracy, or for any other reason. AVU retains, however, the right to modify or remove messages or material that AVU, in its sole discretion, considers infringing, offensive, abusive, defamatory, obscene, stale, or otherwise unacceptable. Whether or not AVU modifies or removes such material, users remain solely responsible for the content of their messages or postings.
You agree that by submitting information for inclusion in any interactive feature, you consent to the publication of that information in these interactive features. You also give (or warrant that the owner of such rights has expressly granted) AVU and/or any affiliated entities the perpetual, nonexclusive right to use such materials (including your questions, comments, and other postings), in their original or edited form, on the AVU Sites, and in books, articles, commentaries or otherwise, in any medium now known or later developed. You also warrant that any "moral rights" in any such materials have been waived. You are not entitled to any compensation for such use.
AVU may, at its sole discretion, terminate the registration of any interactive feature user who violates any of the terms and conditions of use.
No Resale of Service
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.
Termination
You agree that AVU, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any content within the Service, for any reason, including, without limitation, lack of use or if AVU believes that you have violated or acted inconsistently with the Terms and Conditions of Use. AVU may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service may be effected without prior notice, and acknowledge and agree that AVU may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that AVU shall not be liable to you or any third-party for any termination of your access to the Service.
Copyright Complaints
AVU respects the intellectual property rights of others, and requires that users of the AVU Sites do the same. In appropriate circumstances, AVU will terminate the registration of any interactive feature user who is responsible for acts of copyright infringement. The designated agent to receive notification of claimed infringement is The Rector at webmaster@AVU.org .
DISCLAIMERS
THE CONTENT, SERVICES, PRODUCTS AND OTHER MATERIALS MADE AVAILABLE ON THE AVU SITES, OR PROVIDED THROUGH THE AVU SITES BY THIRD PARTIES, ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AVU DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
NEITHER AVU NOR ANY AFFILIATED ENTITIES NOR ANY OF ITS OR THEIR RESPECTIVE LICENSORS, SUPPLIERS OR VENDORS WARRANT THAT ANY FUNCTIONS CONTAINED IN THE AVU SITES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE AVU SITES OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
NEITHER AVU NOR ANY AFFILIATED ENTITIES NOR ANY OF ITS OR THEIR RESPECTIVE LICENSORS, SUPPLIERS OR VENDORS WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE CONTENT, SERVICES, PRODUCTS AND OTHER MATERIALS ON THE AVU SITES, OR WITH RESPECT TO THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. YOU (AND NOT AVU OR ANY AFFILIATED ENTITIES OR ANY OF ITS OR THEIR RESPECTIVE LICENSORS, SUPPLIERS OR VENDORS) ASSUME ANY COSTS ARISING FROM ANY ERRORS, OR FROM YOUR RELIANCE ON THESE MATERIALS. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
AVU does not endorse, warrant or guarantee any products or services offered on the AVU Sites, except as may be expressly stated on the AVU Sites.
LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, WILL AVU OR ANY AFFILIATED ENTITIES OR ANY OF ITS OR THEIR RESPECTIVE LICENSORS, SUPPLIERS OR VENDORS BE LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, ANY CONTENT, SERVICES, PRODUCTS AND OTHER MATERIALS MADE AVAILABLE ON THE AVU SITES, OR PROVIDED THROUGH THE AVU SITES BY THIRD PARTIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN NO EVENT SHALL THE TOTAL LIABILITY TO YOU BY AVU OR ANY AFFILIATED ENTITIES OR ANY OF ITS OR THEIR RESPECTIVE LICENSORS, SUPPLIERS OR VENDORS FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU TO AVU, IF ANY, FOR ACCESSING THE AVU SITES, OR FOR THE APPLICABLE CONTENT, SERVICES, PRODUCTS OR OTHER MATERIALS.
INDEMNIFICATION
You agree to defend, indemnify and hold harmless AVU and any affiliated entities, and each of their officers, directors, employees, agents, representatives, information providers and licensors, from any claims, costs, losses, damages, judgments and expenses, including but not limited to reasonable attorneys' fees and expenses, relating to or arising out of any breach of these terms and conditions, or any use of the AVU Sites, by you or by any other person using the AVU Sites through you or using your password.

Jurisdictional Issues
AVU controls and operates the AVU Sites from the United States. Persons who choose to access the AVU Sites from other locations do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable.
Miscellaneous
These terms will be governed by and construed in accordance with the laws of the District of Columbia without regard to any principles of conflicts of law. You agree that any action at law or in equity that arises out of or relates to these terms will be filed only in the local or federal courts located in the District of Columbia and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. If any of these terms and conditions are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms and conditions, and will not affect the validity and enforceability of the remaining provisions.
This is the entire agreement between you and AVU relating to the subject matter it contains. This agreement may be modified only by posting of changes to these terms and conditions by AVU, or by a writing signed by both parties.
